The United States Sentencing Commission’s guidelines for the sentencing of organizations found guilty of violating federal laws recently became effective. Dramatically increased penalties are possible under these gudelines, but so too is a substantial reduction in the penalties imposed on organizations that have an effective program in place to prevent and detect violations. This provides corporations with a tremendous new incentive in inaugurate organizational ethics audits both to avoid violations in the first instance and to reduce the penalty imposed in (...) the event that a violation occurs. We argue, however, that there have always been very good reasons for organizations to conduct such audits, which emphasize the identification of the organizational factors that create incentives for unethical behavior. Corporate ethics programs initiated without reference to such factors cannot reasonably be expected to be effective in improving a company’s internal ethical environment. (shrink)

Abstract:This essay examines the experiences of three 19th-century African American travelers to Greece—David Dorr (1852), Frederick Douglass (1887), and John Wesley Gilbert (1890–1)—using evidence from their letters, diaries, and published writings. The essay shows that although each traveler's unique personal perspective shaped his response to seeing the ancient sites and monuments of Greece, all three men responded most deeply to a site connected with Greece's Christian heritage: the Areopagus or Mars Hill, where according to 19th-century understanding the Apostle (...) Researchers from across the social sciences have found consistent deviations from the predictions of the canonical model of self-interest in hundreds of experiments from around the world. This research, however, cannot determine whether the uniformity results from universal patterns of human behavior or from the limited cultural variation available among the university students used in virtually all prior experimental work. To address this, we undertook a cross-cultural study of behavior in ultimatum, public goods, and dictator games in a range of (...) small-scale societies exhibiting a wide variety of economic and cultural conditions. We found, first, that the canonical model – based on self-interest – fails in all of the societies studied. Second, our data reveal substantially more behavioral variability across social groups than has been found in previous research. Third, group-level differences in economic organization and the structure of social interactions explain a substantial portion of the behavioral variation across societies: the higher the degree of market integration and the higher the payoffs to cooperation in everyday life, the greater the level of prosociality expressed in experimental games. Fourth, the available individual-level economic and demographic variables do not consistently explain game behavior, either within or across groups. Fifth, in many cases experimental play appears to reflect the common interactional patterns of everyday life. We would like to thank the commentators for their generous comments, valuable insights and helpful suggestions. We begin this response by discussing the selfishness axiom and the importance of the preferences, beliefs, and constraints framework as a way of modeling some of the proximate influences on human behavior. Next, we broaden the discussion to ultimate-level (that is evolutionary) explanations, where we review and clarify gene-culture coevolutionary theory, and then tackle the possibility that evolutionary approaches that exclude culture might be sufficient (...) to explain the data. This study examined whether scaffolded lesson study might contribute to the emergence of a shared professional teaching knowledge culture among 4th grade social studies teachers. The study reports findings from a three-year lesson study professional development project that sought to develop professional teaching knowledge for problem-based historical inquiry among participating teachers. Participants included six 4th grade State History teachers from three different schools and three different school systems. Using qualitative data collected during three yearlong lesson study cycles, we present evidence (...) that suggests that lesson study can be used to develop a shared professional teaching knowledge culture among 4th grade social studies teachers. We suggest, however, that a combination of factors might contribute to variations in teachers' participation in that shared professional teaching knowledge culture including the degree to which the teachers embraced the public nature of lesson study. These factors include the teachers' idiosyncratic views of teaching and learning, the teachers' individual tolerance for socially constructing curricula, and the degree to which teachers acceded to cultural obstacles within elementary schooling. A striking paradox underlies corporate governance reform during the past fifteen years: center-left political parties have pushed for pro-shareholder corporate governance reforms, while the historically pro-business right has generally resisted them to protect established forms of organized capitalism, concentrated corporate stock ownership, and managerialism. Case studies of Germany, France, Italy, and the United States reveal that center-left parties used corporate governance reform to attack the legitimacy of existing political economic elites, present themselves as pro-growth and pro-modernization, strike political alliances with (...) segments of the financial sector, and appeal to middle-class voters. Tomasello provides compelling evidence that children understand that people are morally obligated toward members of their social group. We call for expanding the scope of inquiry to encompass the full developmental trajectory of humans’ understanding of the relation between moral obligation, sociality, and stancetaking in interaction. We suggest that humans display a lifelong preoccupation with the sociality of moral obligation.

Locri Epizephiri, a city-state on the Ionian Sea, established settlements on the Tyrrhenian coast and routes across the peninsula of Calabria. Although some scholars have questioned the importance of land routes over the peninsula, this study indicates these itineraries were vital, particularly during the Classical period when Locri came into conflict with Rhegium, master of the Straits of Messina. This study examines Locri’s struggles for supremacy of the Tyrrhenian coast and investigates the major routes in Locri’s territory between the Ionian (...) and Tyrrhenian seas. The American Foundation Myth in Vietnam deals with how the results of the Vietnam War challenged the long-standing belief in America's role in the world as a unique nation favored by God that carries a global responsibility with it. The author disputes the commonly held belief that America discarded this foundation myth, developed out of John Winthrop's idea of a "city on a hill," following Vietnam. He reexamines the myth in the context of American history to show that (...) the country still firmly attaches itself to the rhetoric of the foundation myth. The analysis divides Americans into one group that believes America's mission cannot be fulfilled without active involvement on the global stage, and one that maintains that its mythic goals are fulfilled most effectively by developing itself as the world's model for freedom and democracy. The tension created between these perspectives creates a dynamic and durable quality that fuels the power of the foundation myth even after a seemingly destructive event such as the Vietnam War. Ethical decisions related to computer technology and computer use are subject to three primary influences: (1) the individual's own personal code (2) any informal code of ethical behavior that exists in the work place, and (3) exposure to formal codes of ethics. The relative importance of these codes, as well as factors influencing these codes, was explored in a nationwide survey of information system (IS) professionals. John Carroll undertakes a careful philosophical examination of laws of nature, causation, and other related topics. He argues that laws of nature are not susceptible to the sort of philosophical treatment preferred by empiricists. Indeed he shows that emperically pure matters of fact need not even determine what the laws are. Similar, even stronger, conclusions are drawn about causation. Replacing the traditional view of laws and causation requiring some kind of foundational legitimacy, the author argues that these phenomena are (...) inextricably intertwined with everything else. This distinctively clear and detailed discussion of what it is to be a law will be valuable to a broad swathe of philosophers in metaphysics, the philosophy of mind, and the philosophy of science. This short but wide-ranging book is a global survey of the history of environmental thought by one of the people most responsible for broadening environmental discussions to include recognition of post-colonial societies. The overall goal of this introductory (...) textbook is to explain multiple environmental discourses from Brazil, the United States, China, India, the Soviet Union, and Africa, and then to situate them as complimentary components of a global socially oriented environmental discursive framework.With that said, it is always difficult to evaluate an introductory textbook. In this case, much of what is covered represents well-worn ground for the environmental scholar. The thesis that emerges is less about a new set of environmental proposals and more about how we ought to understand the history of ideas that informs the development of policy and what ideas ought to be taught in the classroom. Since this book is designed as a textbook, much of my commentary stems from a consideration of how it might work in the classroom. [End Page 132]As an educator regularly teaching courses in environmental thought, ethics, planning, and policy, I have often wondered why so few texts exist on the global history of environmental thought. Guha's work represents an attempt to bridge this gap in the literature. Despite Guha's admirable intentions, I am hesitant to endorse this work as an introductory textbook on the global history of environmental thought for one important reason: Guha's methodology leads to the omission of important components of the global history of environmental thought. From the outset, it is important to acknowledge the difficulty of this type of project. The very title of this work signals perhaps an impossible project, given the 145 pages of text set aside for the task. Guha does cover a number of subjects well, and some are welcome additions to the discussion of the history of environmental thought. Overall though, the topics not covered work to neutralize what is accomplished by the topics that are covered. Consider first what Guha does include.The book is divided into two parts, each focusing on a wave of environmental thought. In the first part, there are four chapters and an afterword. In the initial chapter, Guha argues that a more social and international environmentalism can be a spur to "human reflection and human action," and not just a "scientific study of the state of nature or a balance sheet of the impact of human beings on the earth" (p. 3). While it is common to divide the environmental movement into waves (usually three or four), Guha chooses to delineate only one major shift and thus only two waves of environmentalism. The first wave is comprised of what Guha calls a "period of pioneering and prophecy" and an initial reaction to industrialization; the second wave is comprised of the more socially oriented responses that have emerged in recent decades (p. 3). There are good reasons for delineating more waves, but Guha's project is generally well-served by the two-wave distinction.Guha divides the first wave into three varieties distinguished by their different guiding ideologies—back-to-the-land, scientific conservation, wilderness idea—which are treated respectively in chapters two, three, and four. What I found most compelling about Guha's varieties are some of the figures he chose to include. For example, in chapter two Guha offers a treatment of the back-to-the-land ideology that concurrently condemned excessive industrialization and espoused a commitment to agrarian and pastoral values. In this study John W. Elrod demonstrates that Kierkegaard's pseudonymous writings have an ontological foundation that unites the disparate elements of these books. The descriptions of the different stages of human development are not fully understandable, the author argues, without an awareness of the role played by this ontology in Kierkegaard's analysis of human existence. Kierkegaard contends that the self is a synthesis of finitude and infinitude, body and soul, reality and ideality, necessity and possibility, and time and eternity. (...) Each of these syntheses reveals a particular and unique aspect of individual being not disclosed in the others. Part One shows that ontology is central to the discussion of the self in the pseudonyms. The author notes that spirit, as a synthesis of the expressions of the self, develops as consciousness and freedom. In Part Two he indicates the relationship between notions of being and existence. He notes that existence, in Kierkegaard's thought, grows out of the life of the spirit; the different stages of existence are concrete modes that develop in the spirit's striving to unify the self as a synthesis. These existential expressions of spirit are dialectically related, in that each step requires the preceding stages of spiritual development. Originally published in 1975. John Carroll undertakes a careful philosophical examination of laws of nature, causation, and other related topics. He argues that laws of nature are not susceptible to the sort of philosophical treatment preferred by empiricists. Indeed he shows that emperically pure matters of fact need not even determine what the laws are. Similar, even stronger, conclusions are drawn about causation. Replacing the traditional view of laws and causation requiring some kind of foundational legitimacy, the author argues that these phenomena are (...) inextricably intertwined with everything else. This distinctively clear and detailed discussion of what it is to be a law will be valuable to a broad swathe of philosophers in metaphysics, the philosophy of mind, and the philosophy of science. In lieu of an abstract, here is a brief excerpt of the content:HUME'S IDEAS In the eighteenth century, there was widespread acceptance of a physiological basis for cognition. Some writers even argued for a rather detailed correlation between awareness and physiological changes, suggesting that (a) the former could be adequately explained in terms of the latter or, in some few instances, (b) that the former are the latter. David Hartley may come to mind as fitting one or the other of (...) these alternatives, but Robert Hooke had earlier argued for ideas as brain impressions, as of course did Descartes in his early scientific treatises. There was also one medical doctor in the eighteenth century, Dr. Astruc, who seems (on the basis of what Chambers reports) to have attempted a very specific correlation between specific forms of awareness and specific states and changes in physiology. There were also writers in this century who warned against the dangers of using physical-object vocabulary when talking about the mind and acts of awareness. Berkeley is one such writer,- Thomas Reid at the end of the century traced, to the use of this vocabulary, what he took to be the indirect realism of the way of ideas. Hume is writing in both these traditions: the tradition of using physical language for characterizing mental operations and the tradition of physiological explanations and correlations. The phrase used by Alexander Pope and Hume, 'the anatomy of the mind', seems to be a mixed metaphor, but it is a phrase which I take as an indication that Hume is doing what we would call 'cognitive psychology'. Another phrase used by Hume (this time in the Enquiry), 'mental geography', may capture his enterprise better: 'geography' still sounds physical, but it is modified by 'mental'. Hume is engaged in mental mapping. I want to take a look at the use of the term 'idea' in Hume's writing (mainly in the Treatise) in order to see 2. whether Hume's text enables us to say anything about the nature of his ideas, to discover what role they play in his mental geography. As far as I can determine, there are three possible candidates for the nature of ideas in Hume: images, brain impressions, and cognitive contents. The first of these is, I think, the standard reading of Hume's ideas. Professor Anderson has presented strong argument and evidence to support the second. I will be suggesting that the third is the best candidate, given the full range of the text of the Treatise. Of course, the correct answer 4 may be all three of these. The Treatise opens by dividing all perceptions of the human mind into two kinds. Impressions and ideas differ in the degree of force and liveliness with which they strike upon the mind. Even though the language of 'force' and 'liveliness' may be borrowed from physical talk, it is the mind, not the brain, on which perceptions strike. The examples of impressions are sensations, passions, and emotions. Ideas are said to be the faint images of these impressions in thinking and reasoning. The term 'image' throughout the eighteenth century never receives any clear explication. Its inheritance from optical treatises always hangs about it. We should look to the examples cited by Hume, in order to see whether we can construct a meaning for that term when used in these psychological contexts. Let us look first at his very first example of 'ideas': all the perceptions excited by the present discourse. (Tl) He explicitly excludes from these perceptions those which arise from the sight and touch, as well as the immediate pleasure or uneasiness his discourse may excite in us. The perceptions which are thus excluded are sensations and emotions, the impressions he has just distinguished. The only candidate left for ideas would seem to be what this discourse says, our thoughts about it, my understanding of what it says. YOLTON THE EMPIRICISTPROGRAM has been designed to show that all conscious experience "comes from" unconscious encounters with the environment, and that all intellectual contents (concepts, ideas) derive from some conscious experiential component. Some empiricists, but not all, have also argued that experience reports about the world. A strict empiricism would have to reject this latter claim, as Hume (...) did, although even to consider the possibility of knowledge being related to an external world is to operate on a reflective level, to seek to make sense of experience. The distinction between an account of the nature of experience--its structure, relations, and contents-and explanations of experience--its causal antecedents, its reference--is an important one. The phrase "the concept of experience" refers to the use made of some account of experience. The concept of experience need not be restricted to the experiential contents. Thus, Locke sought to show how experience is of the world, Hume tried to show how experience restricts our valid conceptual contents to certain sorts of ideas, eliminating others. Any account of experience will already be a conceptualization of experience: it must be made from the reflective level. But the account need be no more than a careful record of how the organism comes to the conscious level. Of course, such an account cannot be a straightforward description, since we cannot directly observe all of the processes operating in the production of awareness. The psychology of awareness is forced to extrapolate and conjecture. Nevertheless, we can still distinguish the psychological or descriptive account of experience from the metaphysical use made of that account. It is my purpose here to explore the accounts given and the uses made of experience by two representative empiricists, that is, by philosophers whom we look upon as advancing the empiricist metaphysic of experience. Locke's Derivation o[ Ideas From Experience Locke claimed that all mental contents come from two sources, sensory experience of the world and introspective awareness of our mental processes. The program of Book II of his Essay was to exemplify, by reference to a [53] 54 HISTORY OF PHILOSOPHY number of different ideas and concepts, this derivation of our mental contents. The counter claim for Locke was innatism, the view held by many of his contemporaries and refuted in the first book of his Essay. In order to appreciate what Locke's alternative to innatism was, we must try to discover what the program of derivation of ideas amounts to in his epistemology and what precisely he understood by the term "experience." We must first note that he offers the program of derivation in conjunction with a complex theory of mental operations. H. H. Price has remarked that it is "historically false that the empiricist thought the human mind passive. It would be more just to criticize them for making it more active than it can possibly be.''1 Mental processes play a most active and decisive role in the genesis of all ideas in Locke's account. In the case of simple ideas of sense even, the mind must be attentive to what the senses report, else that report will go unrecorded, or be recorded only at the neural level (II, I, #6, #8, and II, IX, #3). Locke frequently draws the distinction between mental contents or processes and physical processes. In the "Epistle to the Reader," where he defines "idea," he is careful to distinguish idea from the sound we "use as a sign of it." In I, I, #2 he draws a distinction between the "physical consideration of the mind" and the non-physical consideration, although he does not have a name for the latter. He also speaks there of "sensations by our organs" and "ideas in our understanding." Locke disclaimed any intention of going into the physical account of sensation. He simply accepted the current corpuscular theory. But although he is not always as precise as we would be about the physical and physiological levels of encounter, in distinction from the mental levels, he does hold to this division.
